Terms and Conditions

These Terms govern your access to, usage of all content, Product and Services available at https://tankstation.co.uk website (the “Service”) operated by Tank Station (“us”, “we”, or “our”).

Your access to our services is subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.

Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

Intellectual Property

The Agreement does not transfer from Us to you any of Ours or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Tank Station and its licensors.

Third-Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third-Party Services”).

If you use any Third Party Services, you understand that:

  • Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.
  • You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such websites or services.
Basis of SaleTank Station shall sell and the Buyer shall purchase the Goods for the Total Price in accordance with these Terms and Conditions, which shall define the Contract to the exclusion of any other terms and conditions.

No variation to these terms and conditions or any variation shall be binding on Tank Station unless agreed in Writing (which does not include email) by a Main Board Director of Tank Station and agreed in Writing by the authorised representative of the Buyer.

Tank Station employees or agents are not authorised to make any representations or warranties concerning the Goods unless confirmed by a director of Tank Station in Writing.  In entering into the contract the Buyer acknowledges that it does not rely on any such representations which are not so confirmed.

Any typographical, clerical or other error or omission in any sale literature, quotation, price list, acceptance of offer, invoice, email acknowledgement, email confirmation or other document or information issued by Tankstation shall be subject to correction without any liability on the part of Tankstation.

Any advice or recommendations given by Tank Station or its employees or agents to the Buyer or its employees or agents as to storage, application, installation or use of the Goods, which is not confirmed in writing by Tank Station, acted upon entirely at the Buyer’s own risk.

Orders & Specifications

No Direct or Online Order submitted by the Buyer shall be deemed to be accepted by Tank Station and no Contract shall come into effect between the parties unless and until acknowledged by Tank Station and the Buyer receives a Tank Station Online Order Confirmation.

The Buyer shall be responsible to Tank Station for ensuring the accuracy of the information provided by the Buyer in the process of submitting a Direct Order or Online Order. The Buyer is responsible for giving Tank Station any further necessary information relating to the Goods in a Direct Order or Online Order.

The quantity, quality and description of and any specification for the Goods shall be those set out in the Tank Station Order Confirmation or Tank Station Online Order Confirmation.

Tank station reserve the right to make any changes in the specification of the Goods which are required to conform to any applicable safety or other statutory requirements or which do not materially affect their quality or performance.

The Goods displayed on Tank Station’s Website are for illustrative purposes only. The colour of Goods may very slightly from the images used on the Website.

Price of the Goods

The Buyer shall pay the Total Price of the Goods to Tank Station.  Tank Station may quote a price for the Goods.  All such prices quoted are valid for 30 days only and are on an ex-works basis after which time they may be altered by Tankstation without giving notice to the Buyer. This clause shall not apply in the case of  Online Orders, whereby the Total Price shall be stated on the Website at the time of placing an Online Order (subject always to any price changes made in accordance with these Conditions).

Tank Station reserve the right, by giving notice to the Buyer at any time before delivery, to increase the Total Price to reflect any increase in the cost of raw material or delivery cost to Tank Station which is due to any factor beyond the control of Tank Station.

If the cost of manufacture, storage or delivery of the Goods is increased as a result of the Buyer changing the Estimated Delivery Date, quantity or specification for the Goods or where there is any delay resulting from any change of instructions of the Buyer or a failure of the Buyer to give Tank Station adequate information or instructions (including any failure to advise Tank Station of any Delivery Constraint) then Tank Station reserves the right to increase the Total Price to reflect such increase in cost and Tank Station will give notice to the Buyer at any time before delivery of the Goods of such increase in Total Price and any such price increase shall be paid by the Buyer to Tank Station on or prior to delivery.

In case additional costs become payable, the Buyer shall be given an opportunity to cancel their Online Order or Direct Order, as relevant, in the event that the Buyer reasonably concludes within a reasonable timeframe that the increase in the Total Price is too high in relation to the Total Price agreed when the Tank Station Order Confirmation or Tank Station Online Order Confirmation was delivered.

Tank Station.co.uk contains a large number of products and despite our best efforts sometimes a product listed on tankstation.co.uk may be incorrectly priced. This may be due to unforeseen, unscheduled or unannounced price increases from our suppliers and we will do all we can to mitigate this. In such a situation we will verify prices as part of our orders procedure so that the correct price will be notified to you before the contract comes into force.

Terms of Payment

Payment of the Total Price will be made in advance at the time the Direct Order or Online Order is placed, unless additional costs become payable in accordance with clauses 5.2 and 5.3 above, in which case any such additional costs shall be payable on or prior to delivery of the Goods.

If the Buyer fails to pay the total of any sum due the order will be cancelled and the buyer will have to begin the order process again.

Delivery

Delivery of the Goods shall be made by Tankstation to the Delivery address.  Delivery vehicle size will depend on the order and in some cases this mean articulated vehicles and or unloading devices such as an onboard crane. However, Tank Station may use other vehicle types at Tank Station’s discretion.  If the Buyer has a specific vehicle requirement or if there are any limitations on the size of vehicle used for delivery this must be specified by the Buyer as a Delivery Constraint in the Tankstation Order Confirmation or Tankstation Online Order Confirmation.

If it is necessary for the delivery vehicle to have unload capability, the Buyer must make this known at time of order and be aware that delivery costs will be higher for this service.

Time and date for delivery shall be estimated, unless previously agreed by Tank Station in Writing.  Tank Station will endeavour to deliver the Goods on the Estimated Delivery Date(s) but the Goods may be delivered by Tank Station in advance of the Estimated Delivery Date(s) upon giving reasonable notice to the Buyer.

Tank Station may offer to deliver the Goods in instalments, in such circumstances where there is a staggered supply to us. Failure by Tankstation to deliver any one or more of the instalments shall not entitle the Buyer to treat the Contract as a whole as repudiated.

If Tank Station fails to deliver the Goods for any reason other than Force Majeure or any cause beyond Tank Station’s reasonable control or the Buyers fault, and Tank Station is accordingly liable to the Buyer, Tank Station’s liability shall be limited to the excess (if any) of the cost to the Buyer (in the cheapest alternative market) of goods of similar specification to the Goods to replace those not delivered over the Total Price of the Goods.

If the Buyer fails to take delivery of the Goods or fails to give Tank Station adequate delivery instructions at the time stated for delivery then, Tank Station may:

Store the Goods until actual delivery and charge the Buyer for the any additional delivery costs, especially in the case that a delivery attempt has already been made.

If the Buyer decides to cancel the contract and not attempt any further deliveries, the Buyer will be refunded the cost of the product or orders not delivered. This will not include the cost of any failed delivery attempts.

Returns and Refunds

A Buyer which is a Consumer may cancel their Contract within 14 days of the date on which the Contract was formed the “Cancellation Period”. To cancel a Contract the Buyer must complete and submit to Tank Station the ‘Request a Return’ form found on the Website within the Cancellation Period and Tank Station will acknowledge receipt by return email. Any refund due to the Buyer shall be made promptly following cancellation. Unless the Goods have been delivered to the Buyer prior to such cancellation, in which case refund shall be made promptly following the safe return of the relevant Goods (undamaged) to Tank Station.

All Items must be returned unused, refunds cannot be issued for used or previously installed items. In the event that the Goods are returned to Tank Station in a damaged or defective state, Tank Station shall be entitled to deduct from any refund due to the Buyer the amount required to restore the relevant damaged Goods to their original undamaged  or non-defective state.

8.3 If the Buyer receives the Goods before deciding to cancel the Contract, the Buyer must return the Goods to Tank Station without undue delay and no later than 14 days after the Buyer decides to cancel. The Buyer must contact the Tank Station customer service team who will provide full details of the procedure for return of Goods and the costs associated with such return.

Risk & Property

Risk of damage to or loss of the Goods shall pass to the Buyer at the time of delivery at the Delivery address, or at Tank Station’s works.

The property in the Goods shall not pass to the Buyer until Tank Station has received in cleared funds payment, in full, of the Total Price.

The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the Goods which remain the property of Tank Station.

Warranties & Liability

Tank Station shall be under no liability in respect of any defect in the Goods arising from any drawing, design or specification supplied by the Buyer or any failure by the Buyer to install the Goods correctly or failure to comply with Tank Station’s installation guidelines issued from time to time. For the avoidance of doubt, Tankstation is a supplier of Goods and has no input into the design of any project which the Goods maybe incorporated into.

Tank Station shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow Tank Station’s instructions, misuse, alteration or repair of the Goods without Tank Station’s approval;

If the Buyer makes any material alteration to any of the Goods without Tank Station’s prior written approval then all warranties in the Goods either express or implied shall immediately become void.

The Buyer shall within 48 hours of the arrival of each delivery of the Goods, notify Tank Station in Writing of any defect by reason of which the Buyer alleges that the Goods delivered are not in accordance with the specification.

If either party is affected by Force Majeure it shall promptly notify the other party of the nature and extent of the circumstances in question.

As a condition precedent to any claim by the Buyer which is based on any defect in the quality or condition of the Goods or their failure to correspond with specification the Buyer shall notify Tank Station within 48 hours of becoming aware of any defect.  If the Buyer does not notify Tank Station accordingly, the Buyer shall not be entitled to reject the Goods and Tank Station shall have no liability for any such defect or failure, and the Buyer shall be bound to pay the Total Price as if the Goods have been in accordance with the Contract and any specification.

Where any valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods or their failure to meet specification is notified to Tank Station in accordance with these Conditions,  shall be entitled to repair or replace the Goods or refund to the Buyer the Total Price where all of the Goods are defective shall have no further liability to the Buyer.

Except in respect of death or personal injury caused by Tank Station’s negligence Tank Station shall not be liable to the Buyer for any indirect, special, incidental, economic or consequential loss or damage including, without limitation, loss or damage incurred as a result of loss of time, loss of savings, loss of data, loss of goodwill, loss of business or loss of profits which arise out of or in connection with the supply of the Goods or their use or sale by the Buyer, except as expressly provided in these Conditions and in any event exceed the Total Price of the Goods in respect of any event.

Tank Station shall not be liable to the Buyer or be deemed to be in breach of the Contract by reason of any delay in performing or failure to perform, any of Tank Station’s obligations in relation to the Goods, if the delay or failure was due to any cause beyond Tank Station’s reasonable control.

Our Service may contain links to third-party websites or services that are not owned or controlled by Tank Station .

Tank Station assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. Tank Station shall also not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately.

If you wish to terminate the Agreement or your Tank Station account, you may simply discontinue using our Services.

All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer

Our Services are provided “AS IS.” and “AS AVAILABLE” basis. Tank Station and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Tank Station , nor its suppliers and licensors, makes any warranty that our Services will be error-free or that access thereto will be continuous or uninterrupted.

You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of England and Wales.

The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be to the courts of England and Wales or, where the customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.

Changes

Tank Station reserves the right, at our sole discretion, to modify or replace these Terms at any time.

If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.

We will try to provide at least 30 days notice prior to the effective changes. If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.

Your continued use of our Services will be subject to the new terms.
